    Here is the problem

    -- Grass root & state level efforts work only when there are a lot of grass root workers. For example independence struggle in india worked due to grass root efforts. But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.

    Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.

    "Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.

    Folks,

    I edited the letter so please take a look at this version. Some of you'll have suggested I condense the letter to a series of questions alone - I think this is a good idea and will be more effective in capturing attention. I will prepare something in this format (but it will have to wait for the weekend).

    For now, my intent with this letter is to ask that the ARBITRARY nature of the visa bulletin be put to an end. I am exhausted by the cycle of raised and dashed hopes when the visa bulletin moves forward and backward.

    To those of you'll who brought up the issue of schisms between EB2 and EB3, please read paragraph two above. Let us correct this randomness before we tackle each of the issues that are making life so difficult for us. You could start by gathering your friends, co-workers and other EB3 applicants and put together your list of issues to be addressed along with solutions. My view is that if USCIS is incapable of taking care of the matter then we have to pitch in and suggest/prod/request/demand it of/from them.

    Together we can do it!

    Sir/Madam,

    On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration “services” provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

    We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS – a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us – “Case adjudication is based on receipt date” “No, we process applications based on notice date”, “Actually, it’s the processing date that determines which applications are adjusted.” !!!

    Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their “service” centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America’s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service – once applications are submitted to USCIS they disappear into a black hole. Barring a website where one nominally can check one’s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

    While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled – we are bound to our sponsoring employer from the start to the end of the extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

    We request you to lend us your ear and address these issues so that we are not subjected to them in the future.

    Didnt USCIS issue a Memo or something stating only one h1B filing per person?

    I believe this time around USCIS is planning to pick the lottery based on passport number. So, even if you have multiple applications from different companies, you will have to choose one among them.

    But how can that be unless we r mistaken about the category EB1 may be.

    How can there be RD/NDs of 2008 as far as I remember only 15 or 30 days of July were open for filing I-485 after that dates had retrogressed......

    If what u're saying is true...the whole process is as random as possible....

    These are PDs in 2003 or before Apr 2004 cases. VB in Oct 2008 as well as in Oct NOv 2007 was at Apr 2004 thus these guys got approved even though the RDs were in late 2008. I am not sure what the processing times were in Oct NOv 2008 but these were certainly not in 2008 i.e. the processing time must have been in 2007.

    Did you ask her any questions? Like if the case stands preadjudicated or not or if they will need more info in future?

    Going by the questions, it seems she asked all that she can ask for.

    PlainSpeak...F1 are not burden to US, they pay big college fees for the education.

    You know who is real burden, thats H4 visa holders like you. who have nothing to do. they just sit home eat and fight.

    you are a classic example of burden to the society.. you are spending all the time here and fighting with everyone.

    if anyone starts talking about anything, you just come and start fighting.

    I grow different kind in my backyard. It all depends on the size of your backyard and which zone you live in states. I live in virginia. By this August end /september first week summer crop will end. I grow tomatoes(30 plants), Mint, snake guard, water melons (15 plants), cantaloupes(10 plants), carrots, okra, spinach , chillis. Its fun and hard work too. You need to dig the soil, mix with top soil or garden soil and cultivate it. Every week fertilize it. This is my first year gardening. I have around 3000 square ft of back yard. i do not know what to do with that. I cannot maintain Lawn in back yard. So I decided to grow vegetables.
    I am eagerly waiting for my fall garden..I am planning to grow tulips,beets,cilantro,carrots,potato,peas etc., If I can get same space for garden In India and work place just 3 miles from home , I can happily go back to India.

    Thanks for sharing. I am in California. I have about 1600 sq feet to grow our veggies. We use raised beds. I have grown everything you mentioned but could not get snake gourd (paduwal or podlanga). Where do you get the seeds from? I get seeds like Lauki (bottle gourd), Turai (Ridge gourd) etc from amazon. I was never able to grow cantaloupes and melons successfully.

    September tomatoes will be ready to plant soon! Come October, cool season crops like spinach, dill, cabbage, broccoli etc will be planted.

    Someone gave me RED dot for my posting/interpretion of memo (as below). I don't care but some level of maturity is expected on public forums:

    If at all this 'news' is true -this may be just something so-called internal matter. Best interpretion of this 'news' is: They may have assigned available visa#s to approvable petitions just as they did before 2nd July07 bulletin, where people kept getting approvals well into Oct07.
    So, ALL THE BEST to lucky ones who are 'pre-adjudicated'. How else you can explain Sep VB, which is yet to start from 9/1.

    I am going to file my h1 application tomorrow under the master's qouta. I know its nearly impossible that my petition would be approved but I have no other choice. I just have one question:

    1. Should I go for a premium processing?

    <<My OPT expires may 15th and my employer is still willing to file my h1 tomorrow. If I go for premium processing, that will atleast stop me from getting an admit into a community college this fall to maintain my status>>

    Advice please. Also there is no way they will increase the h1b on the master's qouta, right ?

    I think you need to wait until USCIS finish they Lottery/Sorting process.
    At this moment they won't accept your application.

    there were a lot of instances when people do not even know about the visa bulletin even thought they have applied for it a long time ago. especially when they are full time employees well taken care of by their companies. for those gc is just another entity.

    having said that, that should not be a reason to get into trouble in future. will it effect him in the future or not and if so how is something that he should research with an attorney and make a conscious choice for himself.

    on the contrary this is just another incident by USCIS to prove how big time a**h013$ they are. seriously idiots. how come they manage to do such stupid stuff. what can IV do to counter such issues. this is a serious problem and this could jeopordize some one for a mistake from uscis. as a software engg or a mech a engg or a doctor, we as customers should be doing minimal stuff from immigration side. we have better things to take care of. not a useful post but just venting out. sorry guys.

    I don't think you have waited for 6 years after your PD to be able to file for EAD/AOS Benefits... the whole thing is messed up... There are people who filed during July Bulletin Fiasco and there are who could not even though their PDs are before yours. So do you ask them to SHUT UP ?

    Didn't you read what was said by realizeit in his intital post?

    Microsoft and other technology companies hire many workers this way. They often have to prove they can't hire skilled U.S. citizens to fill those jobs first.

    Bill Gates wrote in the Washington Post several years back that there is an employment gap that H-1B visas help fill:

    This issue has reached a crisis point. Computer science employment is growing by nearly 100,000 jobs annually. But at the same time studies show that there is a dramatic decline in the number of students graduating with computer science degrees.

    The United States provides 65,000 temporary H-1B visas each year to make up this shortfall -- not nearly enough to fill open technical positions.

    H-1B workers, who have united under grassroots groups like Immigration Voice , want more than just an increase in visas. They want the government to streamline the rules.

    Currently, the workers have to apply for green cards through their employers, often a lengthy and cumbersome process. They can't switch jobs easily and sometimes have to reapply for a visa even if they move jobs within the same company.     The amount of frustation people go through because of this stupid power mongering false value politicians and the organisations like Numbers USA etc is more than the tragedy of Gulf oil spill. People are holding on to their travel to home country because of this stupid idoitic laws. Educated people are treated like slaves. Why in America Immigration means Illegal? the back log is around 50,000 and added to it 50,000 more will not grab American Jobs. and the American job losses are because of the so called mulltinational companies greed for money, they out source everything to India, China and Philippines. (example Call centers) And offshore development. America only gained because of LEGAL immigration.
