I guess I may fall victim of FBI background check. Even though, my priority date is not current yet but, it should be next couple of months based on recent EB-2 movement. We had our AOS interview last Nov and IO told us that she is going to initiate another Background check as original BC is more than two years old. In the end of April, I made an Infopass appointment out of curiosity because Background check use to be a major source of delay for many people. Service Rep on window told me that my Background check has not come back yet.. It was almost 5 months since it was ordered.. She did not elaborate on why was it pending.. She asked me couple of weird question which did not make any sense to me. I have schedule another appointment in next couple of days to find out where do I stand. I would like to keep my expectations in check as pending BC can delay it even when priority dates are current.
Can anyone on forum please provide some info on what can be done if Background check is pending over 180 days.. I can make a request to my Congressmen and ask for their help... Any suggestions will be greatly appreciated..

Just as an update for those anxious folks - I got my passport back with the stamp on Jan 3rd (Intv was on Dec 13th). Visa issue date was on Jan 2nd.
So plan for 'a month' atleast if you are visiting the Chennai consulate for H1b stamping.
Also make sure your photo is exact as per specs..Mine was taken in US (Costco) for the Green card process ..but the guy who is sorting all the papers in the consulate send me out to the VFS office to take another photo as he didnt like the way my photo was taken (although there was nothing obvious..no point in arguing to them)..I thought I was alone, but saw many folks outside ...I had to take this at the VFS office (close by..VFS shuttle is there outside the consulate) and return back to consulate..(will cause atleast 1.5 hours delay..I barely made it to my flight back home)..

Hello,
We dont see any action from core members anymore. I am watching so many threads. We expect more action items even week or 2 weeks. There are so many ideas floating around and which can get better attention if core works by putting some in agenda. I dont intend to hurt anyone.But we can do more.
I hope I participated more, but hooked up with internation travel every 2 weeks and its sucking my time.
If core is unable to do anything due to lack of money, please let us know that, and there are many who will come forward, but we need soem action that takes care of EVERYBODYS interests.

The above is a fact, not my opinion. Therefore, No - I do not agree that your reasoning has any direct parallel to our case since the correct approach and reasoning involves challenging a Supreme Court Ruling on Article 1 of the Constitution, which you would agree is next to impossible.

This might come as a surprise to some of you, but someone needs to say it out loud. GET A LIFE FOLKS!!!! there is more to life then EB, GC and all. it seem all we desi's can think of is how to get a green card so we can live here with peace and never have to worry bout getting laid off or anything.
Few points:
1) having gc is a privilege not a right.
2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

Tony, I didn't grow up in India. I am oblivious to its education ways. That said, some of the comments expressed here, is not the way to talk to anyone with an education, no matter what school they graduated. Anyway, I'm done here.
Thats cool. I'm sure no one wanted to attack this member directly, but there is a reason why people jumped on the 3 year degree, especially since this is commerce, for a technology job.
I have worked with europeans with 3 year degrees. Many Russians love the BSc physics
3 year degrees are popular and the first choice in many ROW countries (only). I'll leave it at that.
But I have been involved in hiring for quite a few of the top 10 companies in India, and I do know what qualifications they look for and ones they don't look at.
There are exceptions like bugsbunny mentioned - There are some who come from poor families that can't afford the 4 year degree, even at $100-200 a year.
They are too few Ivy league/reputed 3 year degrees in India, unless the field is arts, Law, economics,...
If you don't qualify in the top 5%, you have to shell out $1000-$2000 a year for engineering degree.

with the measures that listed in the bill , i am sure it is going to face same fate as it had before in 07 .I read some where that this bill did not gain support as Oracle is against it .
This bill is against practices that is done mainly by Indian Outsourcing companies, as will impact all the american organizations in longer run (if a company outsource its operations ,they need to have a Permanent local hire to shadow the resource).
But even in the worst case even if bill gets tabled ,it will not gain support in the current form .
But IV Stand is Correct on this issue , not to support this bill as it may hamper our immigrant interest in longer run.

Anti immigration group targets all of the immigration. You can see numbersusa website. There are 2 reasons for the hate towards H1b and L1 program. Fraud and abuse is more in H1b. 20% was found by USCIS. Many fear it could be more. Mainly Indian bodyshopping and consulting companies are main reason. Another reason is many fear that H1b and L1 program is main reason outsourcing. Many big companies laid off US workers and did outsourcing to cut cost and they were asked to give Knowledge transfer to the onsite resources (those who are H1b or L1). Number of jobs in High skilled are very less (may be 2%) compared to low skilled in US. So they think 65k is more in percentage terms. US congress expects that H1b should be used only when no US Workers available. That is the reason there is no support at all at congress to increase H1b Cap. When they put a H1b restriction for TARP companies it was passed uniamously. So if we need EB reform just we need to disassociate or take neutral stand on H1b. They cannot remove H1b as it was with WTO.

AC21 is a law but certain provisions of AC21 have been introduced in separate memos.
Job portability under AC21 is also part of a guidance / memo - so if any AC21 case goes for hearing in an immigration court, any change of employers while 485 is pending is considered illegal. This is not very common though.
Don't assume things and come up with your own theories and scare people. The entire AC21 law is basically dealing with portability at different stages for long delayed applicants.
