my reply was only meant to highlight what you have been doing on this thread. i do not care who is in which EB category. and i know exactly how people with masters degrees suffer in EB3. however, for you to argue that all category preference should just disappear, is quite ridiculous and i have explained the reasons to you. that does not mean people in EB3 are not suffering or that all those in EB3 are either holding advanced degrees or 3 year bachelor degrees. that stereotyping is in your head alone. certainly not in mine. you never answered any of my questions though. what would be the effect of YOUR solutions? would people like me EVER get a GC?

How do you come to these conclusions what congress intended. AC21's main provisions were to recapture unused visas for certain years; extend h-1b beyond six years; allow someone to change a job after 485 pending for more then six months; allow unused visas to be allocated to oversubscribed countries on a quarterly basis rather then in the fourth quarter.
Above is what was changed. There was no lifting of country cap. If you go to the earlies visa bulletins listed; you will see that Dominican Republic at one time was retrogressed. I haven't looked at it in a long time but if someone goes to the historical visa bulletins pre ac21 then you may see significant movement in retrogressed countries in the fourth quarter of uscis fiscal year (july to september). This is what changed.
However, the ac21 part about unused visas only stipulated if in any quarter there were less applicants then visas available then spillover can happen in that quarter. However, as can be seen in 2005 that weasn't the case and there shouldn't have been spillover.
In another posting you mentioned that your employer doesn't care whether you are Indian or chines or pakistani or anything else. This is true they want you for your skill. However, how did you get into USA. Chinese generally go to school here and will work wherever they get a job. However, Indian nationals have designed a system to get their realitves here through h-1b. Selective recrutiing is performed to get fellow compatriates here that couldn't otherwise get here becuase they have no connections. I ask some of my clients how they get employees. They tell me they are sponsoring their classmates, their cousins, etc. for h-1b.
Therefore, you may think it is not fair; and perhaps it is not fair but perhaps government knows that certain systems have been designed and they value diversity.
In business definition a skilled worker is not someone with two years of experience, a bachelors or even a masters. A skilled worker is someone with substantial experience. That is 15 years and makes $200K to $300K. Employment base immigration is just an accomodation to allow a certain number of people into USA. In my mind it is just an accomodation or goodwill.
If the EB system was designd to attract the best and brightest minds; skilled worker definition or eb2 or eb3 definition would have a much different meaning and would follow business rather then USCIS definition. It would be much different. There would be no quota. It would follow normal business practicses. That is we, can't find a us citizen or greencard holder and we need you. In real business sens it would be an offer, acceptance and you would start in a couple of months. However, it doesn't follow normal business rules/practices because maybe the powers that be look at it as just an accomodation rather then a real necessity.
While what you say is from a very neutral perspective as you see things from the other side of the wall, it may not be 100% true in what you think it is. These agencies or companies are a creation of the system, tons of people come from India to fill job positions and systems have been designed to accommodate that. Companies like Wipro, Infosys, etc... have HR people stamp their own H1b visa and send people in a bunch to the consulate for verification.
Indian companies do not 'FAVOUR" Indian workers, but take advantage and try to "EXPLOIT" Indian workers to cater to businesses.

This idea will just put another layer on the GC process. If you are going to make a rule/law to allow this 5 year EAD and new status, why not instead change the LAW to allow higher numbers of yearly GC cards or remove the country based limits.

This is ridiculous. Just trying to blame a good Sherrif.
I am from AZ and Sherrif Joe is the best and the whole country should be proud of him.
He is doing the job which is supposed to be done by Federal govt and ICE, trying to take care of a border state county.

As everyone is aware of the FOIA letters we have received from USCIS. We requested everyone to fax/email us the USCIS letter.
Here is an update on IV plans and what we know till now:
On Friday, during the discussions with USCIS, we came to know that that there is a backlog of FOIA requests and currently they are clearing FOIA requests they received in 2007. We also know from the letter that the report wll not have 'country of chargeability' info. This is a critical info that we ought to have. Even after paying 5K to USCIS, over one year wait time to get the FOIA request completed will be unacceptable to the community.
In light of these developments we have explored other options to get this data and use the copies of replies we get as an example how badly we need this data to get accurate picture of the size and breakdown of the current backlog, so that we can all know how long we need to wait in the current system, if nothing changes. We would also ideally like such data to be always available and updated for public periodically.
Our first option is that we put in effort to get this data without having to pay $5K to USCIS. We will also try to get the data much sooner rather than all of us wait for more than a year.This could be possible via advocacy effort and our initial discussions on this subject have been promising. We will pursue this and if we do not make much progress until the deadline then we may pay 5K and still pursue the advocacy option to get the data faster. Thus we need more than 5K to proceed with these parallel options. The advocacy effort will also be an ongoing task beyond the first month. Thus we request members to sign up for recurring payment option to support this initiative and any other initiative we undertake for the community.
We have added a paypal module on the top of each page with a target amount. Members can use this fresh tool added to IV website to contribute. We prefer if members contributing to the effort on recurring monthly basis for a long term support of IV efforts. All members who contribute through this system will also have access to special 'Contributor's Forum' on the IV website.

On a positive note, the best that we can do is, learn from our surroundings. We can learn a lot from Republicans to understand what not to do.
One of the main reason why Obama enjoys high rating - Republican party sucks. Who is making Republican party look bad - Republicans. The best response to Obama is not to pitch twisted Jindal against Obama, because that just makes Obama look good and it help Democrats. The better response to Obama is, let Obama respond against Obama. So simply don't respond to Obama, which will prevent Republicans making him look good. And like every politician, Obama will commit mistakes, which will cause the demise of Democrats. Its that simple. So what do we learn from this?

Over the years, the tone/tenor of these parties have changed but the core beliefs have remained the same. Liberal Vs Conservatism, Tax cuts Vs Spending, Giving benefits to the comman man Vs giving benefits to small busineses who in turn will help the common man.
Obama's future success lies in how much he can pull the democratic agenda of 'helping 95 % of people who are middle class', building educational infrastructure, taxing businesses while spending to help the 'common' man, reforming healthcare while keeping deficit within acceptable limits ($500 billion maybe perfectly acceptable). A certain section of the republican party (read Bush+Cheney and gang) caused the republicans to take huge losses and gave Obama the boost. Tomorrow it can be Reid+Pelosi+Clinton who can cause the downfall of the democrats by over-doing the 'welfare' agenda. Thus I called it cyclical.

I emailed my lawyer too, A**hole is just repeating that he needs Her Legal name in USA. All her Tax filings, Licence, Social security etc have <First Name>, <Last Name> format. Passport doesn't have surname and Visa has First name - FNU and Surname - Firstname last name. Don't know what to do.

This is a totally wrong message someone out there put out to make people nervous. Application support centers do no have IO's. The only IO's you will meet would be at a different USCIS facility where you take appointment and stand before the counter and ask the questions.
There will be no reason why someone would meet a IO at the fingerprinting place which generally have technicians and security to monitor the process. You sit in a waiting room alongwith 100 other people, then once your name is called, you do the fingerprinting and get out of the door.
There is no time to mingle with IOs nor there will be IOs(friendly or not) who would be willing to disclose any information to you.
Some people online gloat at having pleasure to spread disinformation. this seems to be the case...

I had an infopass appointment today and the IO there told me a lot. She told me that me and my wife's namecheck and fingerprints were cleared. She also told me that the case has not been assigned and therefore she opened a Service Request for me to expedite the case (dont know if it will help). She also mentioned that there is no memo stating that the vsa numbers have been exhausted.
And believe me.. i overheard the other IOs in the saying that the immigration system is screwed up and the service centers dont know what they are doing... so guys you can see what the system thinks of itself.....
so again as i have said....sit tight and hope and pray ....

Are we not human beings? May be we are labelled "aliens" but we are certainly not from Mars! Please consider to clear the long waiting backlogs of the greencard process.

To the corporates, we are high-skilled slaves with no certainity on the status...easy to say..why bother..go back to your country...:o but the reality is different for each person.
To the govt, we are the funding means...(recent H1B/L1 fees ).
To CIS -- our fees is the main source of income to run the shop..
To Illegals -- we (backlogged EB) are hostages to get their wish fulfilled if any...
To Politicians - we are the their subjects in their arguments...
So you think they will listen to you to cut all these cords?? You kidding right.

My friend, Who said its not a problem? in my earlier post I have provided a big laundry list of Line cutting measures in place are these not problems? BUT the point is , is it worth it a fight ? Subs is long gone, We are fighting for Country quota from a year + atleast and we are still at square one and the problems keep worsens. We all worry about subs where there is no action. There is no fixing to this right now its a dead horse. Problem is VISA Numbers in XYZ,000's. Lets recapture them...
Why do you think it is unethical, I was stuck in Labor My comp gave me one option use either subs or dont ask us... In fact I even dont have exact copies of my subs thats hidden from me. So for me is that Unethical? For me a person who qualifies for EB2 and applies now is a line cutter due to the fact that EB2 Q is better than EB3 and they are getting green card faster. Law allows them to do that. is it not jealous to me ? The list grows...
You are an exception of course. But there are so many unethical and undeserving folks that abused this rule and have made things miserable for many of us.
