We can also align ourselves with H1B lobby/Healthcare lobby and request to file I-485 without visa numbers. That will at least stop some of the indentured servitude and our spouses can work.
Why don't we think thorough about this great idea?
I have an amendment to it. Basically all I currently care about is work permit for my spouse, even temporary authorization would please us enormously, say for the period of retrogression delay.

We attached fees to the visas that now bring in millions of dollars. These fees and the dollars that come with it are invested in training grants to educate our own workforce. We use the funds to put kids through school for science, technology, engineering, and math skills. We provide students with scholarships with the hope that they will replace imported foreign workers.
A part of H-1B fee paid by H-1B worker is to replace himself/herself. How nobel!

I saw some postings saying that USCIS can assume the name check is done and is OK if FBI does not get back in 6 months and thats how they managed to approve all those cases in June, is this correct?

But, because everything that I have learnt seems to indicate that EB-3 ROW is getting a lot of visa numbers. So why the hell would it be stuck??

Why dont you call VFS and find out what's happening and if they can help you to resolve this?
I might have more information than VFS. The VFS agents don't know what's happening in the consulate. The agents doesn't know more than what is already present in the VFS website.

I found this only today.. I do not work for this employer since Jan 2008. On EAD now.. 46 days passed since the date mentioned.. not sure what is this about..

As you may know, we are just one more week away from hosting Advocacy day in Washington DC where about 170 members of Immigration Voice will conduct nearly 250 meetings with offices of Senators and Congressmen. Such events cost money. If we have enough contributions, we can spend as per our budget of nearly $ 50,000. If not, we will have to cut back on the event spending and reduce the magnitude and size of the event.
If you are not coming to DC next week, please do your part and contribute funds to Immigration Voice. It not only finances the event properly, it instills pride and confidence in the members who will be there in DC that there are thousands of willing supporters behind them who could not be there physically but are 100% with them in their determination and resolve.

The following are clear cut abuses.
I want to give some fraud and abuse examples. Unfortunately, there are some bad apples in the H-1B visa program.
In 2005, a man was charged with fraud and misuse of visas, money laundering, and mail fraud for his participation in a multistate scam to smuggle Indian and Pakistani nationals into the United States with fraudulently obtained H-1B visas. The man created fictitious companies, often renting only a cubicle simply to have a mailing address. He fabricated tax returns and submitted over 1,000 false visa petitions.
Another man pled guilty last August to charges of fraud and conspiracy. This man and an attorney charged foreign nationals thousands of dollars to fraudulently obtain H-1B visas. He provided false documents to substantiate their H-1B petitions.
Also, an Indian outsourcing company was fined by DOL for paying lower wages. Another example of clear cut fraud.
I am also anxiously awaiting this report.
The U.S. Citizenship and Immigration Service is also worried about fraud in the program. This agency's investigative arm, that subdivision called the Fraud Detection and National Security unit, is doing a fraud assessment of the H-1B and L visa programs. I asked the unit to brief my staff on their work, and they reported they are not finished with analyzing the data. Senator Collins of Maine and I put the agency on notice that we are anxiously awaiting this report so we may continue our quest to reform the program appropriately.
The questions are
What is a fraud?
How will yo detect a fraud?
How many companies are commiting fraud?
How many workers are involved in fraud?
Remember, they are not interested in benefit for worker. That is, something that is a problem for worker (kind of issues mentioned in this thread) are not of interest to them.

Please refrain from fighting on EB3 and EB2 issue. We all know how difficult retrogression has been to every one here. As some one has already said, If interfiling was so easy and every one was fortunate enough to file another Labor/140, EB-2 would have been in 2002 or along with EB-3. AFAIK, Interfiling is some thing the law allows and as long as one does what the system allows and is not gaming the system, its perfectly fine. Don't rub salt on others wounds. Do what you can to improve the system. IMO, the backward movement was a knee jerk reaction to the false demand, shown by USCIS with a huge movement in PD. As you may know, this is purely demand and supply based DOS will move dates forward as soon as they realize that there is not much demand. DOS keeps track of all visa number requests and approvals based on PD's. The problem is DOS just does not know how many applications are pending per country per category to stop the back and forth movement of dates and make the date movement strictly forward. DOS clearly made this a requirement in OCT 08 bulletin and lets see what happens in the next few months. 2nd Q will be key as the over flow will start to trickle based on demand in EB-1+EB-4+EB-5

In reality, many companies who have subsidiaries abroad can use L1 visa program. But H1B offers flexibility that is much desired by many companies. (It is very less abused compared to H1B). No numerical cap on L1B may not go well with many of us. But I am very +ve that the visas are not issued in anticipatory mode like H1B. And why do companies spend 5K if they do not want to get the worker here? Do they like waste money just like that?
Logically this highlights the real problem in the system - numerical caps. If the caps are not there and companies can get a visa-on demand, they will not spend 5K per visa on anticipatory mode. Because there is no need to do that.
So no system is perfect. We have to minimize abuse and act responsibly when it comes to sensitive issues like immigration...
I see only one problem in this logic! Many cases I know of, at least from the 2007 H1B fiasco, paid for the H1Bs through consulting companies FROM THEIR POCKETS. So to answer your question as to why companies would spend $5000 in anticipation, is that they don't. They take it from the applicant. (again I am not saying all do, but there are abusive companies that do).
No cap on visa numbers will never fly... No political environment will be conducive to bringing in unlimited foreign workers without any restrictions. L1 has no caps because it is very difficult to qualify for an L1 visa, as far as I know. If caps in H1 are removed, you can bet there will be severe restrictions imposed on other aspects of the program.

Between and Atlas America for covering pre-existing condition, what would you all recommend?
Definitely, Atlas America as it is a comprehensive coverage plan. Where as 's is a fixed coverage plan which only pays a small fraction of the actual expenses.
Altas America covers $15,000 in acute onset of pre-existing conditions, while claims to cover $50,000 in acute onset of pre-existing conditions for $150,000 coverage.
Lets take the example: Person is hospitalized for two days due to acute onset of pre-existing conditions. And the hospital charged $5,000 per day, for a total bill of $10,000. How much would you get covered in each case?
Atlas America: All $10,000 minus the deductible (deductible choices from $0 to $2,500).
KV Rao: $0 That is because the plan covers at $1,900/day for hospitalization. Therefore, the total coverage is $3,800 but you have a $5,000 deductible. Therefore, you get nothing. Tricky, isn't it? It is not what it seems.
Lets say, even for the new condition. You need a surgery that costs $40,000 (not an unrealistic amount). How much would you be covered in case?
Atlas America: All $40,000 minus the deductible that varies from $0 to $2,500.
KV Rao: Even with $150,000 coverage, they cover only $6,000 for surgery. You have to pay $34,000 out of your pocket.
