Anytime such discussions come up, invariably a few people jump on board threatening to quit IV. Who are you threatening? Are you helping yourself by quitting the fight to solve your problem?
First of all, I am not threatening to quit IV.
Secondly, even if I quit, its not going to matter to IV.
IV's goal is to fight retrogression. So whoever wants to fight retrogression should stay on board.
Thats why I am here. However, everytime someone talks about giving visa numbers from EB3-ROW to EB-2 India/China as the ONLY freaking thing in the world to do, I have to point it out to them that they are talking taking those visa numbers away from ROW-EB3. And that my friend, is not in the interest of ROW-EB3. Nor does it benefit India-EB3, or China EB-3.
However, it is the privilege of a few affected people to discuss their problems on these threads. You are not obligated to follow these discussions if they are not to your taste. It is a legitimate question.
I also enjoy that very same privilege. We are not here for things that we appeal to our 'taste'. This is not a forum discussing 'Borat'. We are here to talk about our interests as they relate to greencard and retrogression.
Clearly USCIS is using one interpretation of the law while there is another possible one.
Exactly. USCIS is using an interpretation of the law. EB-2 India doesn't like the current interpretation. EB-3 ROW doesn't like the alternate interpretaion. EB-3 India doesn't care. If you can say you don't like the current interpretation, you should be ready to hear form others that they don't like the alternate interpretation.
The discussion here doesn't mean that IV will flip tomorrow and say they will fight for only India/China EB2s.
Thats why I am still here. Thats why ROW-EB3 is here. And thats why India-EB3 and China EB-3 are here.
Here is the current situation, as of Febuary 11th, 2007.
EB-3 ROW : BaselineA
EB-3 India : BaselineB
EB-2 India : BaselineC
We make efforts, and then this happens.
Outcome 1:
EB-3 ROW : BaselineA - DeltaA
EB-3 India : BaselineB
EB-2 India : BaselineC + DeltaA
Clearly, this is not an optimal solution.
IV's goals should be, and to the best of my knowledge, are:
Outcome 2:
EB-3 ROW : BaselineA + DeltaA
EB-3 India : BaselineB + DeltaB
EB-2 India : BaselineC + DeltaC
Maybe, DeltaC is the biggest delta and EB-2 India becomes current in a single month. Thats ok. Thats great.
Anytime you talk about Outcome1, you will give a pause to people like me (EB-3 ROW). Lets focus on Outcome2, and you will have my wholehearted support.

Why do they come on wife's account ? Is it legal if spouse makes mistake in any case ?
Wife or child account is considered a 'FAMILY' account and they can impound that account. Unless you divorce your wife and then transfer the money into that account you cannot expect that the money in your wife's (or ex-wife's) account is safe if a judgement is passed against you.

Please Vote, this is one of the best way to know, where we stand. Make a lil easy in making further decisions.

I dont generalize the L1 abuse. This is how it works L1 is meant for company transfer and not to work on consulting positions across United states. Please read the law completely before you know what you are talking about. These L1 people come through intra company transfer and work on $10/ hr jobs undermining the folks on H1-b and L1's too. I dont know about your case and i dont want to comment on it too but do see my point. Please just dont oppose because you have to.
L1's working for consulting should be stopped , it should be meant as intra company transfer for learning and implementation of company projects and not to work at client sites. Thats the law my friend.

Check out the above website. 6039 is the one relating to STEM and it has 26 co-sponsors
If you're looking for a "hot" bill or a controversial issue that's been in the news recently, but you're not sure of its exact title, our page of Hot Bills by issue area is a great starting point for your search. There you can find groups of the most newsworthy bills, and in some cases the most contentious bills in Congress, as compiled by the editors of OpenCongress. It's a handy cheat-sheet of buzzworthy bills and their official titles. The OpenCongress Blog might have written about it recently too and may offer a helpful plain-language summary

and one more point, we are never going to get treated with respect and equality, just get used to it. every American knows we left our country to come to his. he is always gonna look down upon us. Immigrants are never treated with love, respect and dignity, no matter which country they go to. Case in point, Bangladeshi and Nepali migrant workers in India. We treat them like dirt back home, so discrimination against immigrants is part of immigration process. hopefully our ABCD offspring's will face less of it
Excuse me ?? Why did you leave your country and come here ? Your motivations maybe totally different than mine, so don't assume they are the same. For the reason I came over here, why would any 'American' treat me like dirt ? Many countries in Asia are not lands of the immigrant like USA. So your anology of treating migrant workers like 'dirt' to folks over here the same way is totally wrong. Please for heaven sake do some reading before you open your mouth again...you are talking nonsense man....people who are encouraging you are perhaps doing it to see you make a bigger fool of yourself...get off the forums do some reading.

One has to remember that the famous "AC21" is also a memo! My only concern is that we need to have a really good reason why we think AC21 is legal, and should be abided by, by USCIS, but the latest "E-E Relationship" memo is not legal, or is unjust...
AILA wants to fight this on the grounds that such directives cannot be mandated in the form of a memo, but laws have to be passed. What if USCIS retracts the AC21 memo on the same grounds?

I see DOL making so many improvements, PERM process in full gear, BECs finishing up most of their backlogs, and then, no labor substitution rule. Hope USCIS takes some inspiration from them.

Insurance prices are fixed by the insurance company and filed with the government. And government regulates the price. No matter from where you buy the insurance, you will have to pay exactly the same price for the same insurance.
Therefore, it is better to buy from a broker who will be willing to help you not only at the time of sale but if any help is needed at the time of claims. If you buy directly from the insurance company, you are own your own in case you need any help.
Regarding which broker to buy from, call around and find out which one you feel more comfortable with and buy from them.

Thanks for the detailed information.
I have a unique situation here. My original GC sponsor (a multi billion dollar industry leader) laid me off after 6 months of I485 due to lack of position in the company.
I ported my GC using AC 21 and joined another small consulting company. Now my GC is approved and I have an offer in hand from another company.
Will it be a good idea to move or do I have to wait for 6 months or 1 year before I make an employment switch.
My most important consideration is that there is chance of potential loss of job (may god forbid) with the current position. I may be able to save myself by switiching job right now. And of course there is more money on the table.
You are not with your sponsoring employer anyways, so take the new offer if you want. A piece of advice though, for such critical decisions, it is best to spend some money and consult an attorney, rather than muck about on IV and such. An hours consultation ( which all you should need), will cost you u2 may be 3 hundred dollars, but you will get proper advice.

Thank you for great effort. I hope you are not pulling a prank.
Who is the IV member that has asked you to post this info?
Please let us know so that we can all congratulate him.
No ,This is real.
I don't have his IV handle yet.
All thanks to that great vounteer.
Maybe we can use the same route to get info from USCIS.

Please explain why bulletins are applicable to you. Thanks.

Look more closely at a visa bulletin. You will see that in EB3, all countries are retrogressed...
